Driftaway – Terms & Conditions

These Terms & Conditions apply to all travel services arranged by Driftaway (“we”,

“us”, “our”). By requesting services, confirming a booking, or making a payment

through Driftaway, you acknowledge that you have read, understood, and agreed to

these Terms & Conditions.


1. Our Role as a Travel Agent

Driftaway acts as a travel agent and intermediary. We arrange travel products and

services on behalf of third-party suppliers, including but not limited to:

• Cruises

• Accommodation

• Transfers

• Tours and experiences

All travel services are provided by third-party suppliers and are subject to their

individual terms and conditions. Driftaway is not the provider of these services.


2. Quotes, Prices & Availability

• All prices are quoted in Australian Dollars (AUD) unless otherwise stated.

• Prices are subject to availability and may change until payment is received.

• Verbal quotes are indicative only and are not guaranteed until confirmed in

writing or by payment.

• Prices may change due to supplier pricing updates, currency fluctuations,

taxes, fees, or errors.

If an incorrect price is quoted, Driftaway reserves the right to correct the price and

provide you with the option to proceed, amend, or cancel the booking.


3. Payments

• Deposit and final payment deadlines are determined by the travel supplier.

• Failure to make payment by the due date may result in cancellation by the

supplier and the loss of funds paid.

• Driftaway may charge professional service or administration fees, which will

be disclosed to you.

Driftaway service and administration fees are non-refundable, regardless of

whether travel services are cancelled or refunded by suppliers.


4. Cyber Fraud & Payment Security

We take the risk of cyber fraud seriously and encourage clients to do the same.

• Always verify bank account details by contacting Driftaway directly using

contact details obtained independently (e.g. via our website).

• Do not rely solely on email instructions for payment.

• Driftaway will never change bank details without verbal confirmation.

Driftaway is not responsible for losses arising from payments made to incorrect or

fraudulent accounts without proper verification.


5. Cancellations, Changes & Refunds

All cancellations and amendments must be made in writing.

• Cancellation and amendment fees imposed by suppliers are strictly governed

by their terms and conditions.

• Any such fees are your responsibility.

• Driftaway administration fees may apply in addition to supplier fees.

Refunds (if approved by the supplier) will be processed once received by Driftaway.

Driftaway does not guarantee that refunds will be available.


6. Travel Insurance

Comprehensive travel insurance is strongly recommended and should cover, at a

minimum:

• Cancellation and amendment fees

• Medical expenses

• Travel delays and disruptions

• Loss or theft of personal belongings

If you decline travel insurance, you do so at your own risk.


7. Passports, Visas & Entry Requirements

You are responsible for ensuring that you:

• Hold a valid passport (generally with at least six months’ validity)

• Obtain all required visas, permits, and approvals

• Meet health, vaccination, and entry requirements

Driftaway is not responsible for denied boarding, entry, or transit due to inadequate

documentation.


8. Health, Fitness & Special Requirements

Some travel services (including cruises and tours) may require specific health, fitness,

or mobility standards.

• You are responsible for disclosing relevant medical conditions and obtaining

medical clearance where required.

• Driftaway is not liable for denied boarding or participation due to health,

mobility, or fitness requirements.


9. Changes, Delays & Force Majeure

Driftaway is not responsible for delays, changes, cancellations, or disruptions caused

by events beyond our reasonable control, including but not limited to:

• Natural disasters

• Pandemics or government restrictions

• Industrial action

• Weather conditions

• Acts of terrorism

In such circumstances, supplier terms and conditions will apply.


10. Third-Party Suppliers

Driftaway acts only as an agent for third-party suppliers.

• Each supplier operates under its own terms and conditions.

• By booking through Driftaway, you agree to be bound by those supplier

terms.

• Driftaway is not responsible for the acts, omissions, or insolvency of suppliers.


11. Liability

To the extent permitted by law:

• Driftaway’s responsibility is limited to arranging travel services with reasonable

care and skill.

• Driftaway is not liable for loss, injury, illness, damage, delay, or expense arising

from the provision of services by third-party suppliers.

Nothing in these Terms & Conditions excludes or limits your rights under the

Australian Consumer Law.


12. Complaints & Issues During Travel

If an issue arises during travel:

Complaints raised after travel has concluded may be limited in resolution by supplier

policies.


13. Privacy

Driftaway collects and uses personal information solely for the purpose of arranging

travel services and meeting legal obligations. Information is shared only with relevant

suppliers as required. We handle personal information in accordance with Australian

privacy laws.


14. Acceptance of Terms

By confirming a booking, making a payment, or instructing Driftaway to proceed with

arrangements, you acknowledge that you have accepted these Terms & Conditions

and the terms of all relevant suppliers.


15. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia, and any

disputes will be subject to the jurisdiction of the courts of Victoria.
